1. Acceptance of Terms
Welcome to Traffik Boosters ("Traffik Boosters," "Company," "we," "our," or "us").
These Terms of Service ("Terms") govern your access to and use of our website, digital platforms, software, Starz-OS, applications, consulting services, marketing services, automation solutions, artificial intelligence services, training programs, and any related products or services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional agreements applicable to your engagement. If you do not agree, you must discontinue use of our Services.
2. Who We Are
Traffik Boosters is a hybrid growth company that combines digital marketing, business consulting, automation, artificial intelligence, software solutions, analytics, and strategic advisory to help businesses grow more efficiently and profitably.
Depending on your engagement, our Services may include:
- Digital marketing
- Search engine optimization (SEO)
- Paid advertising management
- Social media marketing
- Website design, development, and optimization
- Branding and creative services
- Content marketing
- Email and SMS marketing
- Marketing automation
- CRM implementation and optimization
- AI-powered business solutions
- Starz-OS software and automation platform
- Analytics and business intelligence
- Conversion rate optimization (CRO)
- Traditional advertising
- Training, workshops, and strategic consulting
Certain Services may be governed by separate agreements, including Statements of Work (SOW), Master Services Agreements (MSA), proposals, subscription agreements, or licensing agreements. Where applicable, those agreements control over these Terms.
3. Scope of Services
Every client engagement is unique.
The specific deliverables, pricing, timelines, responsibilities, software subscriptions, implementation schedules, and performance objectives will be outlined in your signed proposal or service agreement.
Any requested work outside the agreed scope may require a written change order and additional fees.
4. Client Responsibilities
To enable successful delivery of our Services, clients agree to:
- Provide accurate and complete information.
- Maintain timely communication.
- Supply requested approvals, content, and account access.
- Ensure they have the legal right to use all submitted materials.
- Review deliverables within agreed timelines.
- Maintain all payment obligations.
- Comply with applicable laws and platform policies.
Project schedules may be adjusted if required information, approvals, or access credentials are delayed.
5. Marketing & Business Performance
Marketing, advertising, and business performance depend on numerous factors outside our control.
Accordingly, Traffik Boosters does not guarantee:
- Search engine rankings
- Advertising performance
- Lead volume
- Website traffic
- Conversion rates
- Sales
- Revenue
- Profitability
- Return on investment (ROI)
- Social media growth
We use commercially reasonable efforts, industry best practices, data-driven strategies, and continuous optimization; however, actual results vary by market conditions, competition, customer demand, budget, product quality, client responsiveness, and other external factors.
6. Artificial Intelligence & Automation
Our Services may incorporate artificial intelligence, machine learning, predictive analytics, automation, and AI-assisted content generation.
AI is intended to enhance efficiency and decision-making—not replace professional judgment.
Clients remain responsible for reviewing and approving all content, campaigns, automations, communications, and business decisions before implementation.
Traffik Boosters does not warrant that AI-generated outputs will be free from errors, omissions, bias, or inaccuracies.
7. Starz-OS Platform
Where applicable, clients may receive access to Starz-OS or related software.
Access may include:
- CRM
- Marketing automation
- Workflow automation
- AI assistants
- Customer management
- Reporting dashboards
- Business intelligence
- Analytics
- Integrations
- Operational management tools
Traffik Boosters grants clients a limited, non-exclusive, non-transferable license to use Starz-OS during an active subscription.
We reserve the right to improve, modify, update, replace, or discontinue features while maintaining commercially reasonable service standards.
8. Third-Party Services
Our Services integrate with third-party providers including advertising platforms, payment processors, cloud hosting providers, CRM systems, analytics platforms, communication providers, and other technology vendors.
Traffik Boosters is not responsible for:
- Platform outages
- Account suspensions
- API limitations
- Algorithm changes
- Policy updates
- Security incidents occurring within third-party systems
- Pricing changes imposed by third parties
9. Payments & Subscriptions
Payment terms are defined within your applicable agreement.
Unless otherwise agreed:
- Service fees are due according to the invoicing schedule.
- Software subscriptions are billed in advance.
- Advertising spend is separate from management fees.
- Late payments may result in suspension or termination of Services.
- Outstanding balances remain payable regardless of suspension.
- Ownership of deliverables transfers only after payment is received in full.
10. Intellectual Property
Clients retain ownership of materials they provide.
Upon full payment, ownership of custom deliverables transfers to the client unless otherwise stated in writing.
Traffik Boosters retains ownership of:
- Starz-OS
- Software
- Source code
- Proprietary frameworks
- AI systems
- Templates
- Processes
- Methodologies
- Trade secrets
- Internal documentation
- Training materials
Nothing in these Terms transfers ownership of Traffik Boosters' proprietary technology.
Unless prohibited by written agreement, Traffik Boosters may reference completed projects in its portfolio and marketing materials.
11. Confidentiality
Both parties agree to maintain the confidentiality of non-public business information disclosed during the relationship.
Confidential information may only be disclosed:
- with written authorization,
- to employees or contractors with a legitimate business need,
- when required by law or court order.
12. Privacy & Data Protection
Our collection and use of personal information is governed by our Privacy Policy.
Clients are responsible for ensuring they have the necessary rights and permissions to collect, process, and provide customer data used in connection with our Services.
13. Acceptable Use
Clients agree not to use our Services for:
- Illegal activities
- Fraudulent or deceptive practices
- Spam
- Malware distribution
- Intellectual property infringement
- Harassment or abusive conduct
- Activities that violate applicable platform policies
Traffik Boosters reserves the right to suspend or terminate Services if these provisions are violated.
14. Limitation of Liability
To the fullest extent permitted by law, Traffik Boosters shall not be liable for indirect, incidental, consequential, special, punitive, exemplary, or lost-profit damages.
Our aggregate liability shall not exceed the total amount paid by the client for the specific Services giving rise to the claim during the twelve (12) months immediately preceding the claim.
15. Indemnification
Clients agree to defend, indemnify, and hold harmless Traffik Boosters and its owners, employees, contractors, affiliates, and partners from claims arising out of:
- client-provided content,
- infringement of third-party rights,
- misuse of the Services,
- violation of applicable law,
- breach of these Terms.
16. Termination
Either party may terminate Services according to the applicable agreement.
Termination does not relieve either party of obligations that accrued before termination.
Upon termination:
- Services may cease immediately.
- Software access may be revoked.
- Outstanding invoices become due according to the applicable agreement.
- Certain provisions of these Terms will survive termination, including intellectual property, confidentiality, indemnification, and limitation of liability.
17. Force Majeure
Traffik Boosters shall not be liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, cyberattacks, internet outages, labor disputes, governmental actions, pandemics, utility failures, or failures of third-party providers.
18. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
19. Electronic Communications
By using our Services, you consent to receive communications electronically, including invoices, notices, updates, and legally required disclosures.
20. Changes to These Terms
We may revise these Terms from time to time.
Updated versions become effective upon publication unless otherwise stated.
Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
21. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22. Entire Agreement
These Terms, together with any applicable proposals, Statements of Work, subscription agreements, Master Services Agreements, Privacy Policy, and other written agreements, constitute the entire agreement between the parties concerning the Services.
